Received a takedown notice? What you need to know as a distributor

Written by Steven Veenstra

Why do we receive a takedown notice?

Sometimes we receive a notification in the form of a takedown notice. This means that a brand owner indicates that a domain name or webshop infringes their trademark rights, for example because a brand name or corporate identity is used without explicit permission.

Although this usually arises from a collaboration between the distributor and the end customer, it's important to emphasise that Premium ID has no direct contractual relationship with the end customer. It is therefore up to the distributor to arrange the necessary permission.

What is a takedown notice?

A takedown notice is a formal request to adjust an online expression (such as a domain name or webshop) or take it offline. The reason is usually that it appears as if Premium ID has a direct relationship with the brand owner in question, while that permission is formally lacking.

Examples of elements that can give rise to a takedown notice:

  • A domain name that contains a protected brand name.

  • The use of a logo, colour scheme or style closely associated with the end customer's brand.

  • Communication that (unintentionally) gives the impression that Premium ID is an official partner of the brand.

Our approach to a takedown notice

When we receive a takedown notice, we take it seriously straight away and carry out the following steps:

  • The domain name in question is adjusted or temporarily taken offline.

  • The shop's visual design is adjusted so that brand names or corporate identities are removed.

  • We contact the distributor involved to explain the situation and discuss how this can be prevented in the future.

Consequences of a takedown notice

  • Temporary interruption of the shop or change of the domain.

  • Delay in delivery or go-live.

  • Unnecessary administrative burden for all parties.

How do you prevent a takedown notice?

To prevent these kinds of situations, it's essential that the distributor obtains written permission from the end customer for the use of their brand name, logo or domain name. This permission enables Premium ID to set up the desired solution safely and correctly, without risk of claims or removal requests.

In addition, we ask you to:

  • Clearly communicate any restrictions or specific wishes of the end customer to us.

  • If in doubt, always consult us before a domain name or design is proposed or delivered.

A takedown notice has an impact on several levels and can easily be prevented by making good agreements in advance.
